Normal use is defined in the manufacturer's warranty. The warranty does not cover consumable parts such as wheels (tyres, spokes or punctures), cables, brake shoes, sets, bottom brackets, the battery or charger, when the defects arise due to mere natural wear and tear of the product.

Any defects found in products that have been manipulated, altered or modified by the User without prior and documented consent from Carpa Design Europe will be excluded from the warranty; if the equipment serial number is damaged or has been removed or tampered with; damages caused by loss or misplacement; those caused by external events, accidents, mainly electrical accidents, wear and tear and use not in accordance with the manufacturer's instructions; or the breakdown of a product caused by the installation of a component not supplied by Carpa Design Europe and incorporated by the client, or that is not compatible with the product.

In the specific case of electric scooters and bicycles, defects caused in the product as a result of: traveling on any unsuitable surface or terrain that could cause damage to the vehicle, such as stairs, slopes, dirt fields, are excluded from the warranty. beach sand, skating ramps, etc.; use it to push or tow other vehicles; participate in races, sports competitions, etc.; perform extreme or demanding driving that causes premature or abnormal wear of vehicle elements that does not correspond to the kilometers traveled; circulate at a higher speed than that established as the maximum by the manufacturer in the technical specifications. Nor will any defects that these products present due to intensive use inappropriate for the recreational and personal purpose for which they must be used by the User be covered under warranty, and in any case, when they have circulated 200 kilometers in total.

Any failure caused by misuse of a product, including water ingress or external damage where this is not included in the manufacturer's policy, may void the warranty.

It is highly recommended that you read the product manual and warranty before using the product to avoid accidentally voiding your warranty.


RIGHT OF WITHDRAWAL


Once the product is received, the User, if their condition is that of a consumer, will have fourteen (14) calendar days counted from the receipt of the last of the products purchased in the same order to partially or totally exercise their right of withdrawal.

Once the form is received, Carpa Design Europe will inform the User of a return number. Once the User has received the return number, they will send the product to Carpa Design Europe, indicating this number in the shipping letter, with the transport costs at their expense, at the address of Carpa Design Europe, SL, C/ Duke of Calabria 4, under Valencia, 46005

In accordance with the exceptions provided for in article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, Carpa Design Europe will not accept withdrawal on products that have been unsealed and without their original packaging.

In case of withdrawal, total or partial, Carpa Design Europe will return to the User, by the same means used to pay, the payments received for the returned merchandise and for the contracted services (collection or transport), which, where appropriate, will be proportional. to the quantity of returned merchandise, within a maximum period of three working days from when Carpa Design Europe had received the returned merchandise.

The right of withdrawal will not apply to products made in accordance with the User's specifications or clearly personalized, as well as those others specified in article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the text recast of the General Law for the Defense of Consumers and Users and other complementary laws.

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online conflicts between the User and Carpa Design Europe, without the need to resort to the courts of law, through intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, and may finally suggest and/or impose a solution to the conflict. APPLICABLE LEGISLATION AND JURISDICTIONAL JURISDICTION


This contract will be governed by the Spanish legislation that is applicable in matters not provided in it regarding interpretation, validity and execution.

In the event of disagreement arising from the purchase of products through the distance selling service, these General Conditions, and for the resolution of any conflicts, the parties agree to submit, waiving any other jurisdiction or jurisdiction to which may have the right to the courts and tribunals of the city corresponding to the User's domicile or the place of fulfillment of the obligation. In the case of companies, the competent Courts and Tribunals will be those provided for in the current regulations for each case.
